Guidelines for Responsible Use of Artificial Intelligence (AI)

InterSystems is committed to promoting responsible AI practices and implementing necessary and appropriate safeguards for AI use. InterSystems promotes transparency and accountability with respect to the use of AI by following our principles set forth at https://www.intersystems.com/about-us/trust-and-responsibility-with-ai/ (AI Principles) as well as all applicable laws, rules, and regulations. InterSystems expects its business partners and other persons engaging with us to be committed to Responsible AI Practices and adhere to all applicable laws, rules and regulations. We do not permit third party AI or ML tools to be used on certain software, including HealthShare, TrakCare, and IntelliCare, our product and service documentation or other identified offerings without our prior consent.

1. Applicability
The AI Principles and these Guidelines should be read in conjunction with any applicable customer contract, intermediary contract or other agreement to which we are a party. However, the below applies specifically to end user customers, partners or natural persons within those organizations who are using our offerings.

2. InterSystems’ Use of AI
InterSystems uses AI across our entire business. AI may be used in our internal business processes to generate materials or deliverables, for service delivery (such as hosting or cloud subscriptions), and in the design, development, and deployment of our licensed products.

In addition, AI may be incorporated as a feature or functionality in our licensed products and other offerings.

  • A. Runtime Services. In some of our offerings, we permit customers to use our technology to utilize the AI services of a third-party provider (“Third-Party AI”).
  • B. Innate AI Features. In some of our offerings, we include AI functionality that has been developed by InterSystems.

3. Transparency
We will endeavour to disclose any use of AI and provide a suitable level of technical information where reasonably possible and appropriate (e.g., through visual icons or tooltips).  In any event, these Guidelines constitute notification to that effect.

4. Responsible AI Practices
We will follow the below Responsible AI Practices and we expect that you will follow them as well:

  • implement technical and operational measures to detect fraudulent use;
  • reasonably ensure use conforms to any intended purpose by employing appropriate controls, especially with respect to decision-making actions;
  • properly disclose AI use to avoid a natural person believing any interactions are with another natural person;
  • maintain human oversight of the use of AI with suitable human verification with AI-generated output;
  • establish feedback to report abuse or problematic issues;
  • Validate appropriate controls on AI use in a high risk or regulated operations;
  • provide necessary transparency notices and obtain consents required by applicable law;
  • mitigate any downstream bias or discrimination arising from AI use; and
  • employ robust cybersecurity and privacy measures.

5. Unacceptable Use
You should not use an AI-enabled InterSystems offering or any Third-Party AI:

  • to reverse engineer, probe the model or undertake adversarial testing on any AI feature made available by InterSystems;
  • as a substitute for professional advice (e.g., clinical, legal, financial);
  • to make automated decisions about individuals without a lawful basis and meaningful human review and validation;
  • to generate or disseminate harmful, deceptive, infringing, or unlawful content;
  • to train your own AI or ML systems unless explicitly authorised in writing;
  • to directly or indirectly create an AI feature or your own commercial offering that competes with InterSystems’ or any Third-Party AI offering;
  • to commercially exploit or circumvent any restriction on InterSystems or Third-Party AI offerings or contracts; or
  • for processing, generating, classifying, or filtering content in ways that can inflict harm on individuals, organizations, or society.

6. Compliance with Laws and Regulations 
As indicated above, we expect your use of AI functionalities and features offered by InterSystems to comply with applicable laws, regulations or other rules. In particular, your use may be subject to what is known as the EU AI Act ( Regulation (EU) 2024/1689 as may be amended). You are responsible for understanding the risk category applicable to your use of an AI functionality or feature. InterSystems clearly articulates the intended use for our offerings and you must not use any AI functionality or feature outside its stated intended use. InterSystems reserves the right to modify any intended use.

7. Customer Inputs and AI-generated Outputs
Unless agreed otherwise in writing, InterSystems will not use your inputs or outputs to train any AI model. InterSystems may analyse AI inputs and outputs for market research, improvements to the systems, and design of new product and services functionalities and features.

GENERAL WARNINGS

AI can produce similar outputs for multiple parties interacting with it meaning AI generated output may not be unique and will not be your sole property.

AI may hallucinate, be probabilistic, be misleading, offensive, incomplete, or inaccurate with AI generated output.

AI generated output may not be reliable or authoritative and must be independently verified.

8. Updates to these Guidelines
These Guidelines may be updated from time to time by posting such update to https://www.intersystems.com/AI-Use-Guidelines. You should check this URL from time to time.

9. Contact and Support
If you become aware of a material risk of any of the following resulting from or in connection with any use of an AI feature provided by InterSystems, you should notify InterSystems within 24 hours.

a) Any harm to individuals, including physical, psychologic, economic, reputational or discriminatory harm;

b) A violation of applicable law, rule or regulation;

c) Significant deviation from expected or intended AI output;

d) Unauthorised disclosure or misuse of personal or sensitive data;

e) Critical failure or misuse of AI in safety, rights or decision-critical contexts (e.g., employment, recruitment, healthcare, legal, financial); or

f) Any other AI-related outcome that requires escalation, investigation, correction or notification under applicable AI governance, ethical or legal frameworks,
